- Definitions – In addition to terms defined elsewhere herein, when any one of the following terms is used in these Terms and Conditions, wherein the first letter is written with a capital letter, then that term shall have the following definition. Words importing persons include corporation, and words importing only the singular include the plural and vice versa when the context requires.
- “Ameren Illinois” shall mean Ameren Illinois Company d/b/a Ameren Illinois.
- “Application” shall mean the Customer completed document used to apply for enrollment to this program.
- “Customer” shall mean an Eligible Customer who has submitted an Application for participation using their Ameren Illinois account number. The Customer abides by these Terms and Conditions upon acceptance of Customer’s Application by Ameren Illinois.
- “Eligible Customer” shall mean a residential customer of Ameren Illinois, with an active Ameren Illinois-delivered electric or combo electric/gas account residing in an eligible zip code under the Program. Individually metered residential Multi-Family units must call to apply for the program. Mobile home residents are not eligible. Installations must be performed between January 3, 2023 and December 31, 2023 to remain eligible for the no-cost direct-install. Equipment and/or materials must be installed at the Customer’s address listed on the Application. See the project/measure eligibility for requirements specific to individual incentives.
- “Program” shall mean the energy efficiency plan or measure that is the subject of the Application.
- “Program Manager” shall mean the Ameren Illinois designee in charge of the Application.
- General – Customer shall abide by these Terms and Conditions; abide by all Local, State and Federal guidelines, applicable laws, building codes, regulations and licensing requirements; and perform work in accordance with customary installation standards, and/or according to manufacturer specifications.
- Post-Installation Verification – A post-installation inspection may be scheduled. This provision may be waived at the sole discretion of Ameren Illinois. Inspections conducted are solely for the purpose of determining Program compliance and are not safety or building code inspections. Inspection may be requested up to one year from date of Application.
- Indemnification – Customer hereby releases and shall indemnify, hold harmless and defend Ameren Illinois, Program staff and authorized Ameren Representatives (collectively, “Ameren Illinois Parties”) and any third-party vendors from any and all claims, losses, harms, costs, liabilities, damages and expenses (including attorney’s fees) of any nature whatsoever arising directly or indirectly out of or in connection within any dispute or legal suit arising from work related to the Program.
- Changes In/Cancellation of the Program – Ameren Illinois may change the Program requirements and incentives or these Terms and Conditions at any time without notice, including suspending acceptance of Applications, denial of Applications already received, or terminating the Program.
- Participation Release – Customer authorizes the release of any smart thermostat usage data if applicable, including customer name and address, to Ameren Illinois, Program Manager, and any contractor or other vendor providing services or support under this Program. Notwithstanding the foregoing, the manufacturer of your smart thermostat will only share with Ameren Illinois, Program Manager, or any contractor or other vendor providing services or support under this Program, your thermostat activation date and status, the date Wi-Fi connectivity is initially established on your thermostat, and the ZIP Code of the installed location to verify your thermostat has been installed and activated within Ameren Illinois service territory. You consent to the manufacturer of your smart thermostat sharing this data with Ameren Illinois Program Manager, and any contractor or other vendor providing services or support under this Program.
- Ameren Illinois does not guarantee that certain energy savings will be achieved and does not make any warranties associated with the product eligible for incentives under this Program. Ameren Illinois will provide device service assistance for 12 months following the date the device is shipped to self-install customers and the date the device is installed for customers who have it professionally installed through the Program. Ameren Illinois Parties have no obligations regarding, and do not endorse or guarantee, any claims, promises, representations, or work made or performed, or equipment furnished or installed by any other contractors, subcontractors, or vendors that sell or install energy efficiency products.
- Miscellaneous – These Terms and Conditions shall be governed by Illinois law.
